Marijuana Business License Application Checklists

Listed below are the materials, information, and acknowledgements required to submit a business license application for medical marijuana and adult use marijuana businesses. The licenses offered by the City of Detroit include:

  • Medical Marijuana Provisioning Center or Adult Use Retailer Establishment
  • Marijuana Grower Facility (Medical or Adult Use)
  • Marijuana Processor Facility (Medical or Adult Use)
  • Marijuana Secured Transporter (Medical or Adult Use)
  • Marijuana Safety Compliance Facility (Medical or Adult Use)
  • Adult-Use Designated Consumption Establishment
  • Marijuana Microbusiness
  • Marijuana Event Organizer
  • Temporary Marijuana Event

Provisional License Applicants (for Legacy Detroiters ONLY)

Provisional licenses only apply to the following license types:

  • Adult Use Retailer Establishment
  • Adult Use Marijuana Grower Facility
  • Marijuana Processor Facility (Adult Use ONLY)
  • Marijuana Secured Transporter (Adult Use ONLY)
  • Marijuana Safety Compliance Facility (Adult Use ONLY)
  • Adult-Use Designated Consumption Establishment
  • Marijuana Microbusiness

After provisional license applicants have identified a location for their business, they must resubmit an application for a full business license (see below).

1. Before you submit your license application:

*IMPORTANT NOTE: In order to receive a license, each entity and each individual involved in the entity must have an approved City of Detroit Income Tax and Accounts Receivable Clearance. Prior to submitting your license, all members/stakeholders/officers of the entity should submit an individual clearance application in addition to the business clearance for the Corporation/LLC (if applicable). You can apply here (short link: http://bit.ly/detroitclearances). Please indicate that you are applying for a marijuana license in your application. 

For example, if you have a corporation and 5 stakeholders, you will need to apply for a corporation clearance and 5 individual income tax and accounts receivable clearances for a total of 6 approvals. If you have questions about who needs to submit for an Income Tax and Accounts Receivable clearance, please contact Taxpolicyandcompliance@detroitmi.gov.

2. In order to submit your license application:

Write or acknowledge in form:

  • Contact info for at least one person who will serve as the point of contact for the company (including name, age, address, principal telephone number and email address)
  • Detroit Legacy certification ID number
  • Acknowledgement to authorize the Detroit Police Department to perform criminal background checks on all individuals identified as part of the ownership entity
  • Acknowledgement of whether any individual with whole or partial ownership of the entity made income in the City of Detroit
    • If no, provide a sworn statement attesting that no income was made in the city that would require the individual to file a City of Detroit income tax return
  • Acknowledgement that the City will investigate the income and property tax status of ALL persons and any medical facilities or adult use establishment related to any of the mentioned persons, and any outstanding taxes, fines, or fees will be paid prior to a license being issued

Items to upload:

  • Driver’s License/State I.D./Passport for the point of contact and all individuals with an ownership interest
  • Organizational documents (i.e., partnership, LLC, sole proprietorship, articles of incorporation, etc.)
    • If your company is owned and controlled by a Detroit legacy applicant: provide documentation and evidence of this (i.e., operating agreement, bylaws, shareholder agreement, etc.)
    • If your company is an organized legal entity: provide the name, mailing address, telephone number and email of all owners, directors, members, managers, officers, partners, or shareholders, as well as the registered agent
  • Comprehensive business plan
  • Prequalification received from the State of Michigan Marijuana Regulatory Agency

3. After you submit your application:

Additional clearances and key items that will be verified by City of Detroit departments once you submit your application:

  • City of Detroit Treasury Clearance (includes verification of income taxes, property taxes, and any outstanding arrears or fees with the City of Detroit)

Full Business License Applicants (if you have a zoned, approved location)

  • Detroit Legacy certification ID number
  • Acknowledgement to authorize the Detroit Police Department to perform criminal background checks on all individuals identified as part of the ownership entity
  • Acknowledgement of whether any individual with whole or partial ownership of the entity made income in the City of Detroit
    • If no, provide a sworn statement attesting that no income was made in the city that would require the individual to file a City of Detroit income tax return
  • Acknowledgement that the City will investigate the income and property tax status of ALL persons and any medical facilities or adult use establishment related to any of the mentioned persons, and any outstanding taxes, fines, or fees will be paid prior to a license being issued
  • The address of the property/building proposed to be used
  • Good Neighbor Plan details, including a community outreach report and plan to ensure awareness of the application and potential employment opportunities in the neighborhoods surrounding the proposed business, as well as one or more of the outlined requirements (NOTE: Medical Marijuana license applicants are exempt from this requirement)
  • Community Outreach notification statement summarizing where you are planning to open your business, approximately how many jobs you anticipate will be available, and where you will post those jobs (on detroitmeansbusiness.org/homegrown and other communication channels).

Items to upload:

  • Driver’s License/State I.D./Passport for the point of contact and all individuals with an ownership interest
  • Organizational documents (i.e., partnership, LLC, sole proprietorship, articles of incorporation, etc.)
    • If your company is owned and controlled by a Detroit legacy applicant: provide documentation and evidence of this (i.e., operating agreement, bylaws, shareholder agreement, etc.)
    • If your company is an organized legal entity: provide the name, mailing address, telephone number and email of all owners, directors, members, managers, officers, partners, or shareholders, as well as the registered agent
  • Comprehensive business plan
  • Prequalification received from the State of Michigan Marijuana Regulatory Agency
  • Proof of property ownership: Notarized Lease, Land Contract/Property Deed, registered with Wayne County)
  • Copy of the conditional land use approval for the intended use or the intended use of an equivalent license
  • Copy of the temporary or final Certificate of Occupancy for the intended use permitted by subsections 9 OR if the location is still in construction, the Building Permit (note that license will not be finalized and provided until final inspections are complete and final Certificate of Occupancy is provided)
  • For Medical Marijuana applicants only: financial documentation demonstrating resources sufficient to meet the capitalization required for the facility or establishment by the state pursuant to the Medical Marijuana Facilities Licensing Act (MMFLA). A certified statement from a CPA is sufficient.

3. After you submit your application:

Additional clearances and items that will be verified by City of Detroit departments once you submit your application:

  • City of Detroit Treasury Clearance (includes verification of income taxes, property taxes, and any outstanding arrears or fees with the City of Detroit)
  • Detroit Health Department inspection of your facility
  • Blight clearance for the proposed location
  • Licensing history, and any violation history (if the applicant is a current or former medical marijuana facility or adult-use establishment state operating license holder)

Renewal: Medical Marijuana Business Licenses

Applies to existing medical marijuana facility license holders seeking to renew their license. Renewals will be valid until September 30, 2022. License fee will be pro-rated until this date. Includes the following existing license types:

  • Medical Marijuana Provisioning Center
  • Marijuana Grower Facility (Medical ONLY)
  • Marijuana Processor Facility (Medical ONLY)
  • Marijuana Secured Transporter (Medical ONLY)
  • Marijuana Safety Compliance Facility (Medical ONLY)

Prior to submitting your license renewal application, all members/stakeholders/officers of the entity should submit an individual clearance application in addition to the business clearance for the Corporation/LLC (if applicable). For example, if you have a corporation and 5 stakeholders, you will need to apply for a corporation clearance and 5 individual income tax and accounts receivable clearances for a total of 6 approvals. 2. In order to submit your license application:

Write or acknowledge in form:

  • The address of the property/building currently used as the medical marijuana establishment
  • Contact info for at least one person who will serve as the point of contact for the company (including name, age, address, principal telephone number and email address)
  • Acknowledgement that the City will investigate the income and property tax status of ALL persons and any medical facilities or adult use establishment related to any of the mentioned persons, and any outstanding taxes, fines, or fees will be paid prior to a license being issued
  • Acknowledgement of any new partners, officers, or owners in your ownership or organization structure since you received or last renewed your license

Items to upload:

  • Copy of your current license from the State of Michigan Marijuana Regulatory Agency
  • Copy of your Certificate of Compliance
  • Driver’s License/State I.D./Passport and contact information for any new partners, officers, or owners in your ownership or organization structure
  • Prequalification received from the State of Michigan Marijuana Regulatory Agency for all new partners, officers, or owners in your ownership or organization structure
  • Organizational documents if there have been any changes in your organization structure (i.e., partnership, LLC, sole proprietorship, articles of incorporation, etc.)
    • If your company is an organized legal entity: provide the name, mailing address, telephone number and email of all owners, directors, members, managers, officers, partners, or shareholders, as well as the registered agent

3. After you submit your application:

Additional clearances and key items that will be verified by City of Detroit departments once you submit your application:

  • City of Detroit Treasury Clearance (includes verification of income taxes, property taxes, and any outstanding arrears or fees with the City of Detroit)
  • Annual Detroit Health Department inspection of your facility
  • Annual Detroit Fire Department inspection of your facility
  • Blight clearance to confirm no outstanding blight
  • Any violation or criminal activity history at the location
